Effective Date: September 22, 2026
These Terms of Use (the “Terms”) govern your access to and use of the website at www.higginsagency.com and any related pages, forms, and content (together, the “Site”). The Site is operated by Higgins Insurance Agency Inc (“Higgins Insurance Agency,” “we,” “us,” or “our”).
Please read these Terms carefully. By accessing or using the Site, you agree to be bound by them. If you do not agree, please do not use the Site.
1. About Our Agency
Higgins Insurance Agency Inc is an independent insurance agency located at 2214 Central Ave NE, Minneapolis, MN 55418. We have served individuals, families, and businesses in the Twin Cities since 1946. We are licensed as an insurance producer in the State of Minnesota.
We are an insurance agency, not an insurance company. We do not underwrite insurance, issue policies, set premiums, or decide claims. Those decisions are made by the insurance carriers with whom we place coverage, under the terms of the policies they issue.
2. The Site Is Informational — No Offer of Insurance
The content on this Site is provided for general informational purposes. It describes the kinds of insurance we can help you obtain and how to reach our agency.
Nothing on this Site is an offer to sell insurance, a binder, a policy, or a guarantee that coverage is available to you or at any particular price. No coverage is bound, changed, renewed, reinstated, or canceled until a licensed representative of our agency confirms it with you and the insurance carrier issues or endorses the coverage in writing.
Never rely on the Site, a web form, an email, a text message, or a voicemail to bind, change, or cancel coverage. Submitting a form or sending a message does not create coverage and does not obligate any carrier. If you need coverage placed or changed urgently, call our office at (612) 789-7231 during business hours and speak with a representative.
3. Quotes and Premium Estimates
Any quote, premium figure, or coverage description you receive through the Site or in response to a request submitted through the Site is an estimate only. It is:
- Based entirely on the information provided to us at that time.
- Subject to verification, underwriting review, and final approval by the insurance carrier.
- Subject to change or withdrawal at any time before coverage is issued.
- Not a commitment by our agency or by any carrier to provide coverage.
Insurance rates, product availability, coverage terms, and eligibility rules change frequently and vary by carrier, by location, and by individual circumstances. The actual premium and terms of any policy are determined solely by the issuing carrier.
It is important that the information you give us is complete and accurate. Inaccurate or incomplete information can result in an inaccurate quote, and in some cases can affect the validity of coverage or the handling of a claim.
4. Certificate of Insurance Requests
Our Site allows you to request a certificate of insurance. A certificate of insurance is issued as a matter of information only. It confers no rights on the certificate holder, does not amend, extend, or alter the coverage afforded by any policy, and is not a substitute for reviewing the policy itself.
We will process certificate requests within a reasonable time during normal business hours. Submitting a request through the Site does not guarantee that a certificate can be issued as requested, particularly where the coverage, the policy terms, or the carrier’s requirements do not permit it.
When you ask us to send a certificate to a third party, you confirm that you are authorized to provide us with that party’s information and to direct us to share coverage information with them.
5. No Professional Advice
Information on the Site, including any articles, blog posts, coverage descriptions, checklists, or examples, is general in nature. It is not legal, tax, accounting, financial, or professional advice, and it is not a recommendation that any particular coverage is right for you.
Insurance coverage is governed solely by the terms, conditions, limits, exclusions, and endorsements of the policy actually issued. If there is any difference between information on the Site and the language of a policy, the policy controls. Please read your policy, and contact us or a qualified professional with questions about your specific situation.
6. Licensing and Geographic Scope
We are licensed to transact insurance business in the State of Minnesota. The Site is intended for users located in the United States, and primarily for residents and businesses in Minnesota.
Nothing on the Site is an offer or solicitation to sell insurance in any jurisdiction where we are not licensed, or where such an offer or solicitation would be unlawful. If you access the Site from outside our licensed territory, you do so on your own initiative and are responsible for compliance with local law.
7. Eligibility and the Information You Provide
The Site is intended for adults. By using the Site or submitting a form, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.
You agree that the information you submit through the Site is true, accurate, and complete, and that you will update us if it changes in a way that affects your coverage or a pending request. Where you submit information about another person or business, such as a certificate holder, you represent that you are authorized to do so.
Please do not submit sensitive information through the Site’s forms. Our forms do not ask for Social Security numbers, driver’s license numbers, dates of birth, or financial account or payment card information, and you should not include them. If we need that information, we will collect it through a secure channel or through the carrier.
8. Acceptable Use
You may use the Site for lawful purposes and for your own personal or internal business use in connection with obtaining or servicing insurance. You agree that you will not:
- Use the Site in violation of any applicable law or regulation.
- Submit false, misleading, or fraudulent information, including in connection with a quote, application, certificate request, or claim.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Use any robot, spider, scraper, or other automated means to access, monitor, copy, or harvest content or data from the Site, including for the purpose of training or supplying a machine learning or artificial intelligence system, without our prior written permission.
- Attempt to gain unauthorized access to the Site, our systems, our networks, or any account or data, or probe, scan, or test their vulnerability.
- Introduce any virus, malware, or other harmful code, or otherwise interfere with or disrupt the operation of the Site.
- Use the Site or any contact information published on it to send unsolicited commercial messages.
- Copy, reproduce, republish, frame, or redistribute any part of the Site for commercial purposes without our prior written permission.
We may suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms or that your use poses a risk to us, to our clients, or to the Site.
9. Intellectual Property
The Site and its contents, including text, articles, page design, layout, graphics, logos, and the arrangement of the foregoing, are owned by Higgins Insurance Agency Inc or our licensors and are protected by copyright, trademark, and other laws.
You may view the Site, and print or download individual pages, for your own personal or internal business use in connection with your insurance needs. All other use requires our prior written permission.
Carrier names, logos, and trademarks displayed on the Site are the property of their respective owners and are shown to identify the carriers we work with. Their appearance does not imply that those carriers endorse our agency, sponsor this Site, or have reviewed its content.
10. Third-Party Websites and Carrier Portals
The Site contains links to websites operated by third parties, including insurance carriers, wholesale brokers, claims administrators, and social media platforms. Our Payments and Claims page links to carrier portals so that you can pay a premium or report a claim directly to your carrier.
We do not process premium payments on this Site. When you follow a link to a third-party site, you leave our Site and enter a site we do not operate or control. We provide these links for convenience only. We are not responsible for the content, accuracy, availability, security, or privacy practices of any third-party site, and a link does not imply our endorsement of it. Your use of a third-party site is governed by that site’s own terms and privacy policy.
11. Electronic Communications
When you use the Site or send us information electronically, you consent to receive communications from us electronically, including by email and, where you have provided a mobile number, by text message. You agree that agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that they be in writing.
Standard email and text message are not secure methods of communication. Please do not use them to send sensitive personal or financial information. How we handle the information you provide is described in our Privacy Policy, including your choices about calls, text messages, and marketing communications.
12. Accuracy of Content and Availability of the Site
We work to keep the Site accurate and current, but insurance products, rates, regulations, and carrier relationships change. Content may become out of date, and the Site may contain typographical errors or omissions. We do not undertake any obligation to update the Site, and we may change, suspend, or discontinue any part of it at any time without notice.
We do not guarantee that the Site will be available without interruption, or that it will be free of errors, viruses, or other harmful components.
13. Privacy
Our Privacy Policy explains what information we collect through the Site, how we use and share it, how long we keep it, and the choices available to you. The Privacy Policy is incorporated into these Terms by reference. By using the Site, you acknowledge that you have read it.
14. Accessibility
We are committed to making the Site usable by everyone, and we describe our approach on our Accessibility Statement page. If you encounter a barrier that prevents you from accessing information on the Site, please contact us and we will work with you to provide that information in another way.
15. Disclaimer of Warranties
The Site and all content on it are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, Higgins Insurance Agency Inc disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.
We do not warrant that the Site will meet your requirements, that access will be uninterrupted or secure, or that any information on the Site is accurate, complete, or current. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
16. Limitation of Liability
To the fullest extent permitted by law, Higgins Insurance Agency Inc and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business, or goodwill, arising out of or relating to your access to or use of the Site, or your inability to use it, whether based in contract, tort, negligence, strict liability, or any other theory, and whether or not we have been advised of the possibility of such damages.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law. These limitations apply to your use of the Site. They do not limit any obligation we may owe you under a written agency agreement, under an insurance policy placed through our agency, or under applicable insurance law.
17. Indemnification
You agree to indemnify and hold harmless Higgins Insurance Agency Inc and its owners, officers, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising out of your use of the Site, your violation of these Terms, your submission of false or unauthorized information, or your violation of the rights of any third party.
18. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. Changes take effect when posted. Your continued use of the Site after we post a change means you accept the revised Terms, so please check this page periodically.
19. Governing Law and Venue
These Terms and any dispute arising out of them or out of your use of the Site are governed by the laws of the State of Minnesota, without regard to its conflict of laws rules. You agree that any action or proceeding will be brought exclusively in the state or federal courts located in Hennepin County, Minnesota, and you consent to the jurisdiction of those courts.
Before filing any action, we ask that you contact us so that we have an opportunity to resolve the matter informally. Most concerns can be addressed with a phone call to our office.
These provisions apply to your use of the Site. Disputes arising under an insurance policy are governed by the terms of that policy and by applicable Minnesota insurance law.
20. General Provisions
- Severability. If any provision of these Terms is held to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full effect.
- No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of our agency or its assets.
- Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding your use of the Site. They do not replace or modify any separate written agreement between us, or any insurance policy.
- Headings. Section headings are for convenience only and do not affect the meaning of these Terms.
